JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-03-2025 Earlier the prayer for pre-arrest bail of the petitioner was stood dismissed as withdrawn by this Court vide order dated 27.02.2024 in Cr. Misc. No. 70040 of 2023 .

2. Heard learned counsel for the petitioner and the State .

3 . Petitioner apprehends arrest in a case registered for the offence punishable under sections 363 , 366 (A)and 324 of the Indian Penal Code read with 8 of the POCSO Act.

4. As per the prosecution case , on 15.12.2021 at around 5:00 PM, while informant was returning home at 7:00 PM after cutting grass, she found that her minor daughter was not at home . Upon enquiry , informant came to know that this

Patna High Court CR. MISC. No.5115 of 2025(2) dt.19-03-2025 2/2 petitioner with the assistance of other co-accused persons kidnapped the minor daughter of informant. The victim in her statement recorded under section 164 Cr PC has supported the prosecution case .

5 . Considering the statement of the victim recorded under section 164 Cr PC , nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
