Petitioner, already in custody, seeks bail in connection with Atri PS Case No.305 of 2017, registered under Sections 399, 414 and 402 of the Indian Penal Code as well as under Sections 25(1-b)a,26,35 of the Arms Act.

Allegation in brief is that the petitioner and one Shambhu Prasad were apprehended on the spot and country made loaded pistol was recovered from each one of them, however rest others escaped away but later on from their possession arms were recovered.

Learned counsel for the petitioner seeks bail of the petitioner on the ground of parity as Shambhu Prasad was

Patna High Court Cr.Misc. No.30527 of 2018(2) dt.16-05-2018 2/2 granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No.21340 of 2018 on 08.05.2018 and this petitioner has also no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Harinandan Yadav @ Haran Yadav @ Harinandan Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Atri PS Case No.305 of 2017.
