This is an application for regular bail in connection with Barhara P.S. Case No.300 of 2017 registered for the offences punishable under Sections 341, 323, 302, 34 of the Indian Penal Code.

It is alleged that petitioner caught hold of the deceased and other co-accused persons gave him knife blows indiscriminately. As a result, the deceased died in course of treatment.

It is submitted on behalf of the petitioner that he is innocent and has falsely been implicated in the present case. Only allegation against petitioner is that he caught hold of the deceased. He has got no criminal antecedent. He is in judicial

Patna High Court Cr.Misc. No.29417 of 2018(2) dt.16-05-2018 2/2 custody since 28.10.2017.

Earlier prayer for bail of petitioner was rejected by this Court in Cr. Misc. No. 14124 of 2018 vide order dated 5.4.2018 with an observation that he may renew his prayer for bail after completion of six months in custody. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barhara P.S. Case No.300 of 2017.
