The petitioner is accused in connection with Brahampur (Krishna Braham) P.S. Case No. 105 of 2019, registered under Sections 457 and 380 of the Indian Penal Code. The accusation is that in the night of 13/14.03.2019, informant, Suresh Rajak, on hearing sound of Khat-Khat woke up and saw that two persons were present in his room. Out of whom, one person was collecting articles from the box and another was keeping the same in the bag. On raising alarm, both started to flee away but one person was apprehended with the help of neighbourers while another succeeded to flee away. The apprehended persons disclosed his name as Ajay Paswan

Patna High Court CR. MISC. No.71390 of 2019(2) dt.11-12-2019 2/2 (petitioner) and also disclosed the name of Ramesh Noniya as his associates, who succeeded to flee away. When the informant checked his box then found ornaments worth of Rs.50,000/- has been stolen.

Learned counsel for the petitioner submits that informant and his neighbourers caught hold the petitioner mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 15.03.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Brahampur (Krishna Braham) P.S. Case No. 105 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
