2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379, 356 of the Indian Penal Code.

3. As per prosecution case, the informant alleged that while he was coming from State Bank of India, Tekari after withdrawing cash of Rs. one lakh, meantime, two miscreants intercepted him and snatched the aforesaid amount thereafter they fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather he has falsely been

Neither the petitioner is put on TIP nor any incriminating article has been recovered from his conscious possession. One mobile is said to have recovered from possession of petitioner which is not stolen article. On the basis of CCTV footage, Pintu Kumar was arrested and he disclosed the name of the petitioner. Save and except confessional statement of co-accused Pintu Kumar, nothing has come against the petitioner to show his involvement in the present case and said Pintu Kumar has already been granted regular bail by this Court vide order dated 31.8.2023 passed in Cr. Misc. No. 55887 of 2023. He has got no criminal antecedent as stated in para-3 of the bail petition. It is further submitted that the petitioner is languishing in judicial custody since 20.4.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Tekari P.S. Case No. 262 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of
