The petitioners apprehend their arrest in connection with Dawath P.S. Case no. 55 of 2019, registered under Sections 147, 148, 341, 323, 325, 307 and 379 of the Indian Penal Code.
The accusation is that Bhagwan Kumar, cousin of the informant, was going to give Rs.50,000/- to Bihari Singh for brick, in way, his villager Nisha Kumari called him for putting the bundle of the crop at her head then he went there, but she on reaching the house made complaint about outraging her
Patna High Court CR. MISC. No.73158 of 2019(2) dt.21-11-2019 2/2 modesty then 12 persons named in the F.I.R., including the petitioners, variously armed with weapons reached there and assaulted, brutally, to Bhagwan Kumar, when his uncle Bihari Singh rushed to save then he also sustained fracture injury on both hands.
Learned counsel for the petitioners submits that while petitioners along with nine others are named in the F.I.R. with allegation of causing injury to Bhagwan Kumar, cousin of informant, and Bihari Singh, uncle of informant, but no specific overt act has been attributed against the petitioners. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj in connection with Dawath P.S. Case No. 55 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
