The petitioner seeks regular bail in connection with Begusarai Muffasil (Singhaul) P.S. Case No. 482 of 2019 for the offence registered under Sections 414 and 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act, 2016.
The allegation is regarding recovery of 407.625 litres of illicit liquor from the saw mill of the co-accused person, namely, Rohit Kumar.
The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that though at the time of filing of the
Patna High Court CR. MISC. No.76874 of 2019(3) dt.17-12-2019 2/2 connected case, the petitioner was having a clean antecedent, however, subsequently he was implicated in one more case. It is further submitted that the petitioner is languishing in custody since 13.09.2019. Lastly, it is submitted that the co-accused person, namely, Rohit Kumar has already been granted bail by a coordinate Bench of this Court by order dated 15.11.2019 passed in Criminal Misc. No. 72334 of 2019.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Muffasil P.S. Case No. 482 of 2019.
