JUSTICE ARUN KUMAR ORAL ORDER 11-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 15.7.2017, seeks bail in Bhorey PS Case No. 25 of 2017 registered under Section 394 of the IPC.

The allegation in brief is that some unknown miscreants robbed motorcycle of the informant and in the process shot at him causing fire arm injury.

Learned Counsel for the petitioner submits that FIR is against unknown, the only material transpired during investigation against the petitioner is disclosure of his name in the confessional statement of co-accused Vishal Mishra and except that there is no other material against him, besides some criminal antecedent in which he is on bail. He further submits that he was also not put on TIP and is in custody since 15.7.2017, similarly situated another coaccused was granted bail by the sessions court itself. Having considered the said facts and circumstances, the petitioner, namely, Vikash Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XII Gopalganj in connection with Bhorey PS Case No. 25 of 2017 with

Patna High Court Cr.Misc. No.29488 of 2018 (2) dt.11-05-2018 the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
