Petitioners, already in custody, seek bail in connection with Bisfi (Patauna) P.S. Case No.14 of 2018 registered under Sections 365 and 364/34 of the Indian Penal Code. Allegation is that the informant's husband went to ease out in the night but did not return back and suspicion is raised against the petitioners.

Learned counsel for the petitioners submits that there is no eye witness in the case, the petitioners are suspected merely on the basis of accusation that the petitioners did not want to return Rs.500/- taken from the deceased and secondly that some dispute existed between them relating to a pond but

No.30079 of 2018(3) dt.18-07-2018 2/2 there was no such enmity between both sides, there is no such strong motive for killing the deceased and except raising suspicion on account of enmity, there is no other material against the petitioners and the petitioners have clean antecedent. Having considered the aforesaid facts and circumstances, petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Benipatti, Madhubani in connection with Bisfi (Patauna) P.S. Case No.14 of 2018 (G.R. No.37 of 2018).
