JUSTICE BIBEK CHAUDHURI ORAL ORDER 05-02-2025 The instant writ petition is filed for proper investigation of the case under Sections 363/365 of the I.P.C., registered as Rupaspur P.S. Case No. 815 of 2023, dated 30th September, 2023.

2. In the instant writ petition, the petitioner has come up with an application for entrusting further investigation of the case to C.B.I., on the ground that neither the Police attached to the concerned Police Station and subsequently Anti Human

Patna High Court CR. WJC No.1914 of 2023(18) dt.05-02-2025 2/3 Trafficking Unit could not unearth anywhere about of the missing girl. The missing girl is a daughter of a Police Officer, who submitted relevant C.C.T.V. footage, on the basis of which three persons were arrested, but no break through could be done by the Police. It is also found that polygraphy test of some other accused persons were not done.

3. Learned counsel for the State/respondents has filed an affidavit in reply to I.A. No. 01 of 2024, accepting the claim of the petitioner to handover further investigation of the case to the C.B.I.

4. In such view of the matter, further investigation of Rupaspur P.S. Case No. 815 of 2023, dated 30th September, 2023 be handed over to the C.B.I.

5. The Police Authority/respondents are directed to handover entire case diary to the Director, C.B.I., Patna for further investigation.

6. The Director, C.B.I., Patna is directed to cause investigation of the case by a competent Officer to come to a logical conclusion in respect of the said investigation.

7. With the above order, the instant criminal writ petition is disposed of.

8. The petitioner is however, at liberty to approach
