JUSTICE SANJAY KUMAR ORAL ORDER 02-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, who is in custody since 01.02.2018, seeks bail in connection with Narpatganj P.S. Case No. 255/2017 registered for the offences punishable under sections 363, 366(A), 385/34 of the Indian Penal Code.

As per allegation, this petitioner abducted the minor daughter of informant by administering intoxication. It has been submitted that the daughter of informant had love affairs with the petitioner and the victim voluntarily left her place and so no case under section 366(A) of the Indian Penal Code is made out against this petitioner.

On perusal of case diary and the statement of

Patna High Court Cr.Misc. No.29555 of 2018 (3) dt.02-07-2018 2/2 witnesses recorded during investigation, I find that the victim was recovered and was produced before the Magistrate where the Magistrate has assessed her age as 16 years. The doctor has also assessed her age as such. The victim in her statement has supported the allegation of her kidnapping by administering intoxication.

Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. His bail prayer stands rejected.
