Despite notices having been received by the opposite party no.2, till date, there is no appearance on her behalf. The petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 1456(C)/2018 in which cognizance has been taken for the offences under Sections 323, 341, 354, 504 of the Indian Penal Code read with Sections 3 & 4 of the Prevention of Witch Practices Act.
The learned counsel for the petitioners submits that the accusation is absolutely false and the prosecution has been lodged with malafide intention.
Regard being had to the nature of accusation against
Patna High Court CR. MISC. No.74832 of 2019(7) dt.29-03-2022 2/2 the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jamui in connection with Complaint Case No. 1456(C)/2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
