The petitioner seeks regular bail in connection with Bela P.S. Case No. 52 of 2018 for the offences punishable under Sections 341, 323, 307, 353, 290 of the Indian Penal Code and Sections 37(b) (c) of the Bihar Prohibition & Excise Act, 2016. The allegation of the prosecution is regarding the petitioner having been found in drunken condition upon being apprehended by the police.

The learned counsel for the petitioner submits that the petitioner is innocent and has a clean antecedent. It is further submitted that the petitioner is languishing in custody since 30.3.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.30770 of 2018 (2) dt.22-05-2018 2/2 case, the petitioner, above named, is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Special Judge, Excise Act, Sitamarhi in connection with Bela P.S. Case No. 52 of 2018.
