JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioners seek regular bail in connection with Wazirganj P. S. Case No. 226 of 2019 registered for the offence punishable under Section 379 of the Indian Penal Code. Prosecution case is of theft of motorcycle of the informant.

Submission of learned counsel for the petitioners is that they were not named in the F.I.R. They were arrested on the confessional statement of the co-accused. They are in custody for four months. Charge sheet has already been submitted, but they have not been put on TIP.

Having heard both sides, in view of the submissions,

Patna High Court CR. MISC. No.72337 of 2019(2) dt.13-01-2020 2/2 made above, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Gaya in connection with Wazirganj P. S. Case No. 226 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
