The petitioner seeks bail in connection with S. Tr. No. 513 of 2017 arising out of Fatuha P.S. Case No. 409 of 2016, registered under Sections 353 and 307 of the Indian Penal Code and 25(1-b)a, 26 and 27 of the Arms Act.

The accusation is that in course of patrolling duty one person was seen moving in suspicious condition. On asking him to stop, he started to flee away making firing, but, he was apprehended. On query, he disclosed his name Munna Singh. When, he was searched five country made pistols along with live cartridges recovered.

Submission is that in fact petitioner is accused in 17 cases, as detailed in paragraph 3 of the petition, but, petitioner is on bail in all cases except Fatuha P.S. Case No. 56 of 2016, due

Patna High Court CR. MISC. No.71287 of 2019(2) dt.11-12-2019 2/2 to that reason the petitioner has been implicated in the present case with allegation of making firing. In the present case, the petitioner is in custody since 22.10.2016.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 513 of 2017 arising out of Fatuha P.S. Case No. 409 of 2016 to the satisfaction of the Additional Sessions Judge, I, Patna City, Patna, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
