JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. This is an application for grant of Anticipatory Bail in connection with Sasaram (Darigaon) P. S. Case No. 34 of 2019, registered for the offences punishable under Sections 147, 149, 353, 323, 427 and 283 of the Indian Penal Code. The allegation is regarding road blocks having been put by the villagers on account of death of one kid due to rash driving by the driver of a tractor and when the police had arrived there, altercation had taken place in between the police and the villagers. In the FIR, seven named and about 100 unnamed accused persons are found to be having complicity in the case.
The learned counsel for the petitioner submits that

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on Anticipatory Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of leaned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Darigaon) P. S. Case No. 34 of 2019, subject to the conditions as laid down under Section 438(2) of the CrPC. (Mohit Kumar Shah, J) Rajeev Kumar/- U T
