2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 365 and 366A of the Indian Penal Code.

3. As per allegation in the FIR, 17 years old daughter of the informant left her house for college but did not return till late evening. She has strong apprehension that petitioner no. 1 has kidnapped her who used to vicit the house of petitioner no.

2. It is further alleged that accused persons giving threatening on regular basis.

4. It is submitted by learned counsel for the petitioner

Petitioner no. 2 is own uncle and he also lived in same house. And petitioner no. 1 is brother-in-law of petitioner no. 2. It is further submitted that husband of the informant execute their ancestral property in the name of his wife (informant vide sale deed no. 18530 dt. 1.2.2022, which was objected by the petitioner no. 2 and only because of this, they have been dragged in the present case with false and concocted story. In statement of 164 Cr.P.C. victim girl has given tutored statement and stated that both accused persons had abducted her and after filing of the case, they left her at Hajipur. She has not made specific allegation of physical exploitation. Petitioner is in custody since 4.8.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection
