The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Purnia Sadar P.S. Case No. 470 of 2019 registered for the offence punishable under Sections 25(1-b)A, 26, 27 and 35 of the Arms Act. The case of the prosecution is that the Police party had conducted a raid and the petitioner was apprehended and upon search one country made pistol with live cartridge is said to have been recovered from the possession of the petitioner. The learned senior counsel for the petitioner submits that the petitioner is a school teacher and has been falsely implicated in the present case. It is further submitted that though

No.72384 of 2019(2) dt.25-11-2019 2/2 initially seven criminal cases had been lodged against the petitioner herein, however, he has been acquitted in three cases and he is on bail in rest of the four cases. The petitioner is stated to have been languishing in custody since 11.09.2019. Having regard to the facts and circumstances of the present case, I deem it fit and proper to direct for grant of regular bail to the petitioner herein immediately upon completion of six months of custody i.e. with effect from 11.09.2019, subject to such conditions as may be imposed by the learned trial court i.e. the learned court of C.J.M., Purnia in connection with Purnia Sadar P.S. Case No. 470 of 2019. With the above observations and directions, the present petition stands disposed off.
