====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-06-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Didarganj P.S. Case No.163 of 2017 registered under Sections 341, 323, 498A and 504/34 of the Indian Penal Code. The accusation of the informant is that on 08.10.2017 at about 10.00 A.M., her husband Shailendra Singh (petitioner) and other in-laws started to abuse and caused injury to her through fists and slaps. They also caused injury on the forehead of the informant by pushing her forehead on the wall. Learned counsel for the petitioner submits that, admittedly, the petitioner is the husband of the informant, and due to some minor dispute, the informant has lodged this false

Patna High Court Cr.Misc. No.30959 of 2018(2) dt.11-06-2018 2/2 case. It is further submitted that it would appear from the F.I.R. that no allegation of demand of dowry and torturing the informant for non-fulfillment of the same has been made against the petitioner and others, as such, Section 498-A of the Indian Penal Code is not made out. So far as the offences under Sections 341, 323 and 504/34 of the Indian Penal Code is concerned, the same are bailable. Further submission is that the petitioner is still ready to keep the informant with full honour and dignity.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Patna City, Patna, in connection with Didarganj P.S. Case No.163 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
