1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Pipra Police Station Case No. 239 of 2025, dated 23.05.2025, disclosing offences under Sections 126(2)/115(2)/118/109(1)/303(2)/74/76/351(2)/352/3(5) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, as per the written report, is that on 22.05.2025, at about 07:00 PM, while the informant was standing at the shop of one Jagdish Kumar, the petitioners, along with other accused persons, armed with iron rod, talwar (sword) and garasa, assaulted him. On the
Patna High Court CR. MISC. No.78132 of 2025(2) dt.24-12-2025 2/3 instigation of petitioner no. 2, co-accused Tilak Prasad assaulted him on the head with iron rod due to which he sustained injury. When the informant's mother intervened, accused petitioner no. 1 assaulted her by means of garasa due to which she got injured and co-accused Sanjeet Kumar assaulted the informant's wife by means of a lathi. It has further been alleged that petitioner no. 2 outraged the modesty of informant's wife and also took Rs. 5,700 from the pocket of the informant.
4. Learned counsel for the petitioners submits that both the parties are agnates and the petitioners have falsely been implicated in the present case due to dispute regarding passage. He next submits that counter case has been lodged by the side of the petitioners, bearing Pipra Police Station Case No. 240 of 2025 against the informant and others. He furthers submits that the injuries caused to the victims are simple in nature. The petitioners have got no criminal antecedent.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates having dispute regarding passage, case and counter is there between them and the victims have
Patna High Court CR. MISC. No.78132 of 2025(2) dt.24-12-2025 3/3 sustained simple injuries, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate Sadar, East Champaran, Motihari, in connection with Pipra Police Station Case No. 239 of 2025, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
