2. The petitioner seeks bail in connection with Mahila P.S. Case No. 40/2025 registered for the offences punishable under Sections 64, 126(2), 115(2), 352, 351(2), 3(5) of B.N.S. and Sections 4/6 of POCSO Act.

3. As per the prosecution case, petitioner, a neighbour, regularly visited the victim's house and molested her for two years. On 08.05.2025, he raped her, gagged her, and later promised to marry her. Consequently, she became pregnant. When her mother approached the petitioner's family, they threatened to kill them

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that petitioner has clean antecedent and he is in custody since 19.06.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the aforesaid submissions advanced on behalf of the parties as well as the fact that from the statement of the victim, it appears that she was in a relationship with the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court, POCSO-III, Muzaffarpur/concerned Court below in connection with Mahila P.S. Case No. 40/2025.
