2. The petitioner seeks bail in connection with Manjhagarh P.S. Case No. 250 of 2024 registered for the offences under Sections 126(2), 115(2), 109, 103, 85, 352 and 351(2)/3(5) of the Bharatiya Nyaya Sanhita.

3. The petitioner is named in the F.I.R. and is in custody since 31.08.2024.

4. The allegation against the petitioner is to assault father of the informant along with other named co-accused persons by using brick plates etc., causing injury upon chest, where occurrence is alleged to have taken place arising out of

Patna High Court CR. MISC. No.83838 of 2024(9) dt.04-08-2025 2/3 demand of Rs. 5,00,000/- as dowry.

Learned counsel appearing on behalf of the petitioner submitted that petitioner is son-in-law of deceased, where for certain family disputes occurrence took place, but it was given colour that same occurs in the background of dowry demand. It is submitted that case was registered for the occurrence of murder, where informant is the eye-witness of the occurrence and almost with same allegations as raised through FIR against other named co-accused persons namely Jojan Yadav & Shivji Yadav have already been granted bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 82909 of 2024 dated 31.01.2025.

It is submitted that though in post-mortem report subcutaneous layer of sternum found with clotting of blood, but the nature of allegation suggests a general and omnibus allegation against petitioner qua physical assault, where implication, prima-facie, appears out of relation as petitioner is son-in-law of deceased.

Patna High Court CR. MISC. No.83838 of 2024(9) dt.04-08-2025 3/3 is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, while opposing the prayer for bail could not dispute the aforesaid factual submission.

In view of aforesaid facts and circumstances as mentioned above and by taking note of fact as other similarly situated co-accused persons have been granted bail by learned Co-ordinate Bench of this Court, accordingly by taking note of judicial parity, coupled with the fact as petitioner remains in custody since 31.08.2024, accordingly above named petitioner, is directed to be released on bail in connection with Manjhagarh P.S. Case No. 250 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-VI, Gopalganj/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
