ANJANA MISHRA ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 30.03.2018 in connection with Darbhanga Sadar P.S. Case No. 92/2018 registered for the offences punishable under Sections 363/365 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the present case is one of unnatural death, a case has been registered bearing U.D. Case No.03 of 2018 dated 08.03.2018 after a lapse of 21 days. The present FIR was filed stating that the last communication made between the informant and his son was from the mobile phone of the present petitioner who had stated that he was going to his Sasural. Under such circumstances, the

Learned counsel further submits that save and except the said circumstances, there is no further cogent material in the case diary to implicate the petitioner with the death of the son of the informant and the petitioner has got no criminal antecedent. In view of the above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Sadar P.S. Case No. 92/2018. (Anjana Mishra, J) Saif/- U T
