JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Rivilganj PS case no. 17 of 2018 instituted for the offences punishable under Sections 25(1-b)a, 26, 35 of Arms Act. The allegation is regarding recovery of arms and ammunitions as well as stolen motorcycle from the accused persons. As far as the petitioner is concerned, one live cartridge and a mobile phone were recovered from his pocket. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and he is said to be languishing in custody since 17.01.2018.

No.31630 of 2018 (2) dt.31-05-2018 2/2 Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-VIII, Saran at Chapra in connection with Rivilganj PS case no. 17 of 2018.
