JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Sono P.S. Case No. 177 of 2012 dated 25.12.2012 instituted for the offences under Sections 419, 420, 468, 471, 34 of the Indian Penal Code.

The petitioner is alleged to be a middleman who had created troubles for the informant in getting his passbook under the MANREGA scheme.

The learned counsel for the petitioner has submitted that nothing specific has been alleged against the petitioner and the allegation of unauthorized withdrawal of money from the account of the informant is alleged against others. The petitioner has been made accused in this case at the instance of a defeated/erstwhile Mukhiya for the reason that the

Patna High Court Cr.Misc. No.32154 of 2018 (4) dt.29-06-2018 2/2 petitioner had supported the present Mukhiya in the elections. The petitioner is also suffering from mental illness. Considering the aforestated facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Jamui in connection with Sono P.S. Case No. 177 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
