Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 9.5.2017 passed in Cr. Misc. No.20704 of 2017 with a direction to the learned trial court to conclude the trial without a period of 9 months and liberty has been given to the petitioner to renew his prayer for bail and if the trial is not concluded.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 19.2.2017 and recovery is of 01 kg. Ganja, which is less than the commercial quantity. Heard learned A.P.P. also.

From perusal of the report, it appears that the case is for argument and the learned trial court has assured that it may be

Patna High Court Cr.Misc. No.30509 of 2018 (3) dt.20-06-2018 2/2 concluded within a period of two months.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the same and conclude it within the period as assured by him.
