JUSTICE NANI TAGIA ORAL ORDER 27-06-2025 This contempt application has been filed alleging violation of the order dated 04.04.2019 passed in CWJC No. 3174 of 2016 by which order the respondent No.2 therein / the Principal Secretary, Department of Health Medical Education and Family Welfare, Govt. of Bihar was directed to decide the matter if the petitioner files a representation making out his claim with regard to payment of ACP/MACP, as the case may be.

2. Opposite party No.1/ the Principal Secretary, Department of Health Medical Education and Family Welfare, Govt. of Bihar has filed a show-cause wherein it has been stated that though LPA No. 1498 of 2019 was filed challenging the

Patna High Court MJC No.4592 of 2019(2) dt.27-06-2025 2/2 order dated 04.04.2019 passed in CWJC NO. 3174 of 2016, on a representation dated 17.01.2020 filed by the petitioner, for grant of MACP was considered and was rejected by an order dated 17.01.2020 passed by the Special Secretary, Health Department, Government of Bihar, which order has also been enclosed as Annexure-A to the show-cause filed by the opposite party No. 1.

3. On verification made in the website of the Court regarding the status of the LPA No. 1498 of 2019, it has been found that the same was withdrawn on 06.05.2024. A web-copy of the same has also been placed in the record, which shall be treated as a part of the record.

4. Since the representation filed by the petitioner for grant of MACP has been rejected vide order dated 17.01.2020 passed by the Special Secretary, Health Department Government of Bihar (annexure-A to the show-cause), I find that the order dated 04.04.2019 passed in CWJC No. 3174 of 2016 has been duly complied with by the respondents.

5. Accordingly, the contempt application stands closed and disposed off.
