2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25 (1-b)a, 26 and 35 of the Arms Act.
3. The case of the prosecution is that from the bed box of this petitioner, one rifle and cash was recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that in this case while making the search, the police has not complied Section 100 of the Cr.P.C. and the witnesses are the police personnel and not the independent witness. Patna High Court CR. MISC. No.83108 of 2024(3) dt.17-03-2025 2/2 submitted that the petitioner was not present at the time of seizure and he has also not the resident of that house. Moreover, the petitioner is languishing in judicial custody since 29.06.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Maner P.S. Case No. 410 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Danapur/concerned Court.
