The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 133 of 2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 5.800 ml. of country made Mahua wine was kept in a bag. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent. In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to

No.71577 of 2019(2) dt.21-11-2019 2/2 deposit of Rs.2,000/- in the Patna High Court Legal Services Committee, Patna and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Patna in connection with Athmalgola P.S.
