A Supplementary affidavit has been filed on behalf of the petitioner. The same be kept on record.

The petitioner seeks bail in a case registered under Sections-498A, 304(B), 201/34 of the Indian Penal Code. Allegation against the petitioner is of committing torture and caused death of the deceased due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24-10-2017 and has got no criminal antecedent. There is no allegation of tampering of witnesses against the petitioner. The petitioner has been made accused in the

Patna High Court Cr.Misc. No.30736 of 2018 (6) dt.09-08-2018 present case due to mistake of fact and the same would be evident from the compromise petition (Annexure-5 to the supplementary affidavit) filed by the informant, in which, the informant has retracted from the statement made in the FIR. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Gaya in connection with Wazirganj P.S. Case No. 475 of 2017.
