2. The petitioner seeks bail in connection with Kasba P.S. Case No. 151 of 2023 registered for the offence under Section 376(D), 506 of the Indian Penal Code and under Section 6 of the POCSO Act.

3. As per the prosecution case, the victim girl was taken away by the petitioner and others and Samsad and Sajjad raped upon her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and there is no specific allegation against the petitioner and he further submits that the medical report does not support the prosecution case.

5. It is also submitted by the learned counsel for the

Patna High Court CR. MISC. No.84087 of 2023(2) dt.10-01-2024 2/2 petitioner that the petitioner has no criminal antecedent and he is in jail since 27.04.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Kasba P.S. Case No. 151 of 2023.
