The petitioner is in custody in connection with Special Case No.101 of 2017 arising out of Khushrupur P.S.Case No.139 of 2017 registered for an offence under Sections 399, 402, 353, 307 and 414 of the IPC, section 25(1-b)a, 26, 33 and 35 of the Arms Act and Sections 20 and 22 of the NDPS Act. Learned counsel for the petitioner submits that though the recoveries are alleged to have been made, the quantity so recovered is not of a commercial quantity and five persons have been apprehended. Out of the apprehended accused Akram Mahir and Md. Faizuddin Alam have been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.11738 of 2018. The petitioner

Patna High Court Cr.Misc. No.30805 of 2018 (4) dt.05-07-2018 2/2 is in custody since 20.07.2017 having clean antecedent. The learned APP opposed the submissions.

Considering the aforesaid facts and circumstances, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-X-cum-Special Judge (NDPS), Patna in connection with Khushrupur P.S.Case No.139 of 2017 with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
