Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 452, 354A and 354B of the Indian Penal Code and Section 8 of the POCSO Act. Informant has alleged in her written complaint that on 20.05.2019 at about 11:00 pm in the night Kisua Devi mother of the petitioner called her and took her to her house and when she returned she found the lights of her house switched off and her minor daughter Guddi Kumari 13 years, was not present in the house and when she heard her screaming she went there and saw petitioner is teasing her minor daughter, she tried to catch him but he fled away. She has further stated that petitioner is her neighbour and on 21.05.2019 at about 6:00 am he came and started abusing and threatening him.

No.72760 of 2019(2) dt.21-01-2020 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to previous enmity. It has been further submitted that incident is of 20.05.2019 whereas FIR has been lodged on 26.05.2019. Prior to lodging of FIR the mother of the petitioner had lodged a complaint case against the Informant with respect to brutal assault to the son of the petitioner by the Informant and his family. Petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of his/her arrest or surrender before the court below within a period of four weeks, be released on anticipatory bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Pakarideyal P.S. Case No. 131 of 2019, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
