2. The petitioner apprehends his arrest in a case in connection with C.R. Case No. 1867/2021, arising out of Samastipur Town P..S. Case No. 179 of 2019 registered for the offences punishable under Sections 406, 420, 120B & 34 of the Indian Penal Code, 1860.

3. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. After investigation, Police has filed the final form against the petitioner and the informant has

Patna High Court CR. MISC. No.83259 of 2023(2) dt.08-01-2024 2/2 filed protest petition against the final form but the court below has taken cognizance against the petitioner.

4. Learned APP for the State has opposes the prayer for bail.

5. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with C.R. Case No. 1867/2021, arising out of Samastipur Town P..S. Case No. 179 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

6. The petitioner is directed to cooperate in the trial, if the petitioner shall not appeared on two consecutive dates fixed by the trial court, the bail bond of the petitioner shall be cancelled by the court below.
