JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioners apprehend their arrest in connection with Bihta P.S.Case No. 788 of 2017 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation of kidnapping is against the petitioners and other accused persons.

Submission of learned counsel for the petitioners is that FIR reveals that one Monu Kumar had taken away the victim girl and thereafter names of the petitioners transpired showing that hands of the petitioners were also in the kidnapping. Further submission is that in her statement recorded under Section 164 Cr.P.C. the victim girl has not named these petitioners. Heard learned APP also.

No.31216 of 2018 (3) dt.27-06-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, in connection with Bihta P.S.Case No. 788 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
