JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 19-11-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State duly assisted by learned counsel appearing suo motu for the informant.

2. Both accused/petitioners are named in the FIR and apprehending their arrest in connection with Piprahi P.S. Case No.140 of 2025 registered under Sections 64, 89, 352, 351(2) read with 3(5) of the Bhartiya Nyaya Sanhita, 2023 (in short 'BNS').

3. Considering the submission, as the allegation of rape is not available against both petitioners rather FIR

Patna High Court CR. MISC. No.78718 of 2025(2) dt.19-11-2025 2/2 speaks that five co-accused persons including these petitioners forced the victim aged about 19 years for her medical termination of pregnancy being relative of main coaccused Dharmendra Kumar, which upon medical examination, not appears convincing, accordingly, both above-named petitioners, who are men of clean antecedent, are directed to be released on bail, in the event of their arrest or surrender in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S. Case No.140 of 2025, subject to the conditions as laid down under Section 438(2) of the CrPC/under Section 482(2) of the BNSS.
