Case No. 09 of 2018 registered for the offences punishable under Sections 272 & 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016. Recovery of 130 liters of liquor from the motorcycle of the petitioner. He was not arrested at the spot and his name was disclosed by the other co-accused person. Submission of learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against him. He is in custody for three and half month, having no criminal antecedent. Charge sheet has already been submitted, as such, there is no chance of tampering with the evidence.

No.71470 of 2019(2) dt.13-01-2020 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Act, Gaya, in connection with Kothi P. S. Case No. 09 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
