The petitioners seek bail in connection with Chapra (Muffasil) P.S. Case No. 347 of 2019 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a)/41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that there is recovery of 2557.86 liters of foreign liquor from the Tata Goods Carrier Van. Learned counsel for the petitioners further submits that there is no recovery from the conscious possession of the petitioners. Petitioners are the driver of the said vehicle.

No.73867 of 2019(2) dt.27-11-2019 2/2 Leaned counsel for the petitioners further submits that the petitioners are in jail custody since 10.09.2019 and he further submits that the petitioners have no criminal antecedent. In the facts and circumstances of the case, I am inclined to grant bail to the petitioners, subject to deposit of Rs.25,000/- in the court below/Nazarat. Let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Saran at Chapra in connection with Chapra (Muffasil) P.S. Case No. 347 of 2019.

Such deposit of Rs.25,000/- shall abide by the outcome of the criminal case.
