The petitioner is languishing in custody for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

According to FIR, co-accused Sheikh Rabis and Sheikh Bablu are assailants of the deceased by causing fire-arm injury. Though allegation of firing on the informant is there against the petitioner also, however, no injury was caused. Land dispute is the reason for the occurrence. The petitioner has stated on oath that he has got no criminal antecedent. Investigation of the case is already complete against the petitioner. There is no allegation of tampering with the evidence. No.77620 of 2019(3) dt.09-12-2019 2/2 completion of investigation and the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gopalpur P.S. Case No.210 of 2016, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
