1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The learned counsel for the petitioner, at the outset, submits that Sanotsh Kumar Soni, Kedar Nath Sah, Raj Kumar Yadav and few others have been granted the privilege of regular bail by the learned District Court itself. It is further submitted that Sanotsh Kumar Soni, from whose possession looted articles were also recovered, was also granted the privilege of regular bail by the learned District Court. It is next submitted that name of this petitioner transpired in the confessional statement of apprehended accused, which does not have any evidentiary value.
3. The learned A.P.P. submits that petitioner is seeking
Patna High Court CR. MISC. No.84097 of 2024(4) dt.19-04-2025 2/2 anticipatory bail while the co-accused have been granted the privilege of regular bail by the learned District Court.
4. At this stage, the learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application with liberty to move before the learned District Court for seeking regular bail.
5. Permission is accorded.
6. Accordingly, instant petition is dismissed as withdrawn.
