The petitioner seeks regular bail in connection with Sadar P.S. Case No. 475 of 2019, registered for the offence punishable under Sections 406, 420, 467, 468, 470, 471 and 34 of the Indian Penal Code.

The allegation is regarding the petitioner, who is stated to be the agent of the transporters, having undertaken to transport the maize belonging to the informant to Assam by trucks and after the maize was sent by trucks, it is alleged that the driver had fled away with the truck and maize. It has been further alleged that the petitioner herein in collusion with the transporters & driver of the truck have misappropriated maize of the informant worth Rs.16.50 lakhs an odd.

No.71184 of 2019(2) dt.10-01-2020 2/2 The learned counsel for the petitioner has submitted that the petitioner has been alleged to be the agent of the transport company in question and he is having no complicity in the matter. It is submitted that the transporters have already been granted the privilege of regular bail by this Court by an order dated 4.12.2019 passed in Criminal Miscellaneous No. 74883 of 2019. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 16.9.2019. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the parity of the case of the petitioner with that of the co-accused persons, who have been already granted bail by this Court, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S.
