The petitioners seek regular bail in connection with Bhargama PS case no. 247 of 2017 instituted for the offences punishable under Sections 413, 414/34 of Indian Penal Code. The allegation is regarding the accused persons being apprehended while they were transporting stolen buffalo. The learned counsel for the petitioners submits that as far as the petitioners are concerned, they were not a party to the co-accused persons transporting the stolen buffalo and infact, their names transpired subsequently upon the confession made by the accused persons. The petitioners are said to be languishing in custody since 28.11.2017. It is further submitted that the

Patna High Court Cr.Misc. No.32281 of 2018 (2) dt.24-05-2018 2/2 co-accused persons, who are the main accused, have already been granted bail by this Court by an order dated 25.04.2018 passed in Cr.Misc. no. 23693 of 2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Bhargama PS case no. 247 of 2017.
