The petitioner seeks bail in connection with Buxar (Town) P.S. Case No.605 of 2019 registered under Sections 366(A), 341, 323, 504 and 506/34 of the Indian Penal Code. The accusation is that Hajrun Bibi, the mother of the petitioner, came at the house of the informant and accompanied his daughter but the daughter of the informant did not return. On query, the parents of the petitioner asked the informant that his daughter had gone with the petitioner to somewhere else and they will return from there. In spite of passing over 4-5 days, when the daughter of the informant did not return, then the informant went to the house of the petitioner to make query about her, then this petitioner and his parents, while abusing, committed "Maar-Peet" with him and forced him to move from there.

No.71474 of 2019(2) dt.04-03-2020 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, due to love affair with the petitioner, the daughter of the informant, according to her own sweet will, moved from her house and started to live with the petitioner at Dumraon. On the death of the father of the petitioner, the petitioner along with the daughter of the informant came at his house, then the petitioner was apprehended by the police. Similar statement has also been given by the daughter of the informant in her statement recorded under Section 164 of the Code of Criminal Procedure on 13.09.2019. The petitioner is in custody since 13.09.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Buxar (Town) P.S. Case No.605 of 2019.
