====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-06-2018 Heard Sri Ajay Kumar Pandey, learned counsel for the petitioner and Sri Shailendra Kumar Singh, learned Additional Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Bhagwanpur P.S. Case No. 58 of 2018, registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016 , has prayed for grant bail in the event of his arrest or surrender primarily on the ground that one of the co -accused, in similar circumstances, has been granted bail. He submits that one of the co-accused : Pramod Chaudhary has been granted bail on 04.06.2018 vide Cr. Misc. No. 30851 of 2018. He further submits that petitioner is having clean antecedent , which fact has been stated in paragraph no. 3 of the

Patna High Court Cr.Misc. No.31613 of 2018(2) dt.12-06-2018 2/2 petition and petitioner's name has come in confessional statement of the co- accused.

Considering the fact that one of the co- accused, in similar circumstances, has been granted bail as well as clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner- Kamdeo Kumar @ Kamdeo Chourasiya @ Kamdeo Chakurasiya be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II cum Spl. Judge, Excise Court, Begusarai / concerned court in connection with Bhagwanpur P.S. Case No. 58 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
