The petitioner seeks regular bail in connection with Aurangabad Town P.S. Case No.97 of 2018 for the offences punishable under Section(s) 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153(A), 295(A) & 379 of Indian Penal Code.

The allegation in brief is tht on the occasion of procession of Ram Naumi, members of two religious community clashed with each other and indulged in arson and loot.

Learned Counsel for the petitioner submits that large number of persons have been made accused in the case but no specific overt act has been attributed to the petitioner or the other accused persons and even no incriminating material has been recovered from the possession of the petitioner.

No.31746 of 2018 (2) dt.31-05-2018 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 97 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
