2. The petitioner seeks regular bail in connection with Dumra P.S. Case No. 139 of 2023 for the offences registered under Sections 356 and 379 of the Indian Penal Code.
3. It is alleged in the prosecution case that on the date of occurrence at about 11.00 AM informant was going to his house with his Mausi on motorcycle. When they reached near over bridge at N.H.-77, two persons on a motorcycle came there and snatched the mobile of the informant from his pocket. Mausi of the informant tried to clutch the hands of the miscreants but she fell down getting injury.
4. Learned counsel for the petitioner submits that petitioner is innocent. He has falsely been implicated in this
Patna High Court CR. MISC. No.81350 of 2023(2) dt.08-01-2024 2/2 case. Nothing has been recovered either from the conscious possession of the petitioner or from his house. No Test Identification Parade has been conducted in this case. Chargesheet has already been submitted before the learned Trial Court. Petitioner has one criminal antecedent. He is in judicial custody since 15.08.2023.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Dumra P.S.
