2. The petitioners have prayed for bail in connection with Vishambharpur P.S. Case No. 121 of 2024 registered for the offence punishable under Sections 126 (2), 115(2), 137(2), 140(3), 142, 61(2) and 3(5) of the Bhartiya Nayay Sanhita, 2023.

3. The case of the prosecution is that one infant was kidnapped by Manorama Devi @ Chhema Devi, wife of Amit Singh, Amit Singh, Sudhir Singh and Chanda Devi. During course of investigation, it has come that Chhema Devi @ Manorama Devi and Runa Devi were going to Lucknow via Prayagraj and the infant was recovered from the lap of Chhema Devi.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. It is further submitted that from perusal of the F.I.R. and the diary, it transpires that the allegation against the petitioners is that they were involved in conspiracy. No overt act is alleged against them. Even the kidnapped infant was not recovered from their possession. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. They are languishing in judicial custody since 29.08.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gopalganj in connection with Vishambharpur P.S. Case No.121 of 2024.
