====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-06-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant.
The petitioners apprehend their arrest in connection with Masrakh P.S. Case No.30 of 2018 registered under Sections 341, 323, 353, 427 and 504 of the Indian Penal Code. The accusation is that the informant Chanda Kumari being the teacher of the Upgraded Middle School, Jajauli, reached at the school on 01.02.2018 at about 09.30 A.M. Thereafter, Headmistress Punita Kumari alias Kumari Punita (petitioner no.1) along with her husband Jai Kishore Singh (petitioner no.2) and others also came at the school and after

No.31713 of 2018(2) dt.13-06-2018 2/3 opening the office of the school, petitioner no.1 started to put signature on the Attendance Register, then the informant made protest, saying that she has come first, so she will put the signature on the Attendance Register first due to which there was hot exchange of words in between them. In that course, the petitioner no.2, the husband of the petitioner no.1 dashed the informant due to which she sustained injury. Anyhow, the matter was pacified. At that time, the petitioner no.2 tried to tear the Attendance Register of the school but, anyhow, on the intervention, the register was saved.
Learned counsel for the petitioners submits that the petitioner no.1 is the Headmistress of the said School where the informant joined as a teacher but in the light of the direction of the Hon'ble High Court to the effect that the teachers, who have been appointed illegally, may resign voluntarily, the informant gave her resignation but, later on, after obtaining the forged certificate from the B.D.O., the informant tried to join in the said school as a teacher but the petitioner no.1 being the Headmistress of the said school made protest, due to that reason, the informant has lodged this false case against the petitioner no.1 and her husband (petitioner no.2). The petitioners have no criminal antecedents.

No.31713 of 2018(2) dt.13-06-2018 3/3 Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Saran (Chapra), in connection with Masrakh P.S. Case No.30 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
