The petitioner seeks bail in connection with NDPS Special Case No. 32 of 2020 arising out Bakhtiyarpur P.S. Case No. 49 of 2020 instituted for the offence under Sections 20(b) (ii)(c) & 22(c) of the NDPS Act.

Petitioner had earlier moved this Court four times i.e. Cr. Misc. No. 2233 of 2021, which was rejected vide order dated 31-08-2021, Cr. Misc. No. 38087 of 2022, which was dismissed as withdrawn vide order dated 24-08-2022, Cr. Misc. No. 54566 of 2022, which was rejected vide order dated 21-12-2022 and Cr. Misc. No. 78434 of 2023, which was rejected vide order dated 05-04-2024.

A report was called for from the trial court and it is reported that out of twelve charge sheet witnesses, eight witnesses have been examined and trial is likely to be concluded within a period of two months.

After hearing learned counsel for the petitioner, this Court does not find any fresh ground for reconsideration of the matter, which is already decided on merit. This Court would further take note of the fact that petitioner is in custody since 14-02-2020.

Considering the aforesaid facts and circumstances of the case, specifically taking into account the fact that trial is on the verge of its conclusion, this Court is not inclined to take a different view of the matter. Prayer for bail is, accordingly, rejected.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.

The District Magistrate, Patna and the Senior Superintendent of Police, Patna are also directed to take necessary steps to produce the witnesses on the date fixed in the trial court so that the trial could be concluded at the earliest. 9.
