JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bahadurganj P.S. Case No. 334 of 2018 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
Allegation is of committing theft of motorcycle, which was recovered and petitioner is not named in the FIR but later on in the confessional statement of co-accused the name of petitioner has been transpired.
Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and one co-accused whose name has also been transpired in the confessional statement has already been granted anticipatory bail by a co-ordinate Bench of this Court by
Patna High Court CR. MISC. No.73324 of 2019(2) dt.19-11-2019 2/2 order dated 21.10.2019 passed in Cr.Misc.No. 63388 of 2019 and petitioner has no criminal antecedent.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Bahadurganj P.S. Case No. 334 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation and appear before the police as and when required.
